Tough Tech Coatings WARRANTY INFORMATION:
This warranty is provided on behalf of Tough Tech Coatings Products,. to customers who submit a warranty form for our do it yourself roofing products
DEFECTS IN MATERIALS:
Tough Tech Coatings Products, Inc. warranties its products against defects in materials for life time from the date of purchase. If a valid claim is submitted by the customer (as set out below) in accordance with this Warranty Certificate, Tough Tech Coatings Products, Inc. will replace any defective product with an identical or functionally similar product in complete satisfaction of its obligations hereunder.
This will apply only to areas of product failure. In the event a section of an application has failed due to product failure, Tough Tech Coatings Products, Inc. will provide enough product to blend into our existing system to replace the impacted area. This is valid only up to the quantity of the original products purchased by the customer for the application.
LIMITATIONS:
This warranty is limited to the replacement of the products that, in the reasonable opinion of Tough Tech Coatings Products, Inc., fail to function as originally designed. To obtain such a replacement, the customer must show evidence of a material defect in the product within the warranty period. Tough Tech Coatings is a commercial grade roofing system whose primary focus is to provide a long lasting, watertight roof.
Due to the “do it yourself” application procedure, variance in roof structures, existing roof conditions, as well as local weather conditions, Tough Tech Coatings Products, Inc. cannot guarantee the final cosmetic appeal of the roof system. Cosmetic imperfections on top of the roof that do not affect the performance of the Tough Tech Coatings roof system are not considered warranty items.
Tough Tech Coatings warranty on this roofing system is for life time from the date of purchase. This warranty is valid only when the warranty form on Tough Tech Coatings/warranty is submitted within 90 days of purchase. This form must include Name, Email, Phone, Purchase Information, and Before and After Photos of the completed application to be eligible for warranty coverage.
Tough Tech Coatings Products, Inc. shall not be liable for any defect relating to any matter outside the control of Tough Tech Coatings Products, Inc. In particular, this warranty shall be void if, in the reasonable opinion of Tough Tech Coatings Products, Inc., the product has been damaged as result of an accident, improper handling, unauthorized or inappropriate use, abuse, neglect, unauthorized repair or modification, overloading, natural calamities, acts of vandalism or terrorism, or if the customer is in default of any amounts owing to Tough Tech Coatings Products, Inc.
Tough Tech Coatings Products, Inc. shall not be liable for any defect relating to any matter outside the control of Tough Tech Coatings Products, Inc. In particular, this warranty shall be void if, in the reasonable opinion of Tough Tech Coatings Products, Inc., the product has been damaged as result of an accident, improper handling, unauthorized or inappropriate use, abuse, neglect, unauthorized repair or modification, overloading, natural calamities, acts of vandalism or terrorism, or if the customer is in default of any amounts owing to Tough Tech Coatings Products, Inc.
This warranty shall also be void if the customer has acted fraudulently or has delivered to Tough Tech Coatings any incorrect or inadequate information or has withheld any material information. This warranty, at the sole discretion of Tough Tech Coatings Products, Inc., may be void if an accessory or ancillary product has been installed after the original installation of the Tough Tech Coatings system as shown in the before and after photos submitted at toughtechcoatings.com/warranty within lifetime of purchase and causes a material defect to the original Tough Tech Coatings installation.
In addition, any modifications made to the original Tough Tech Coatings roof installation, may at the sole discretion of Tough Tech Coatings Products, Inc. void this warranty.
Tough Tech Coatings Products, Inc. neither assumes, nor authorizes any representative to assume for it, any obligation or liability other than as set out herein.
This warranty is not limited to the original customer. The customer may transfer or assign this warranty. Simply pass the purchase information and warranty information on to the next owner. The new owner will be required to submit a transfer of warranty form at our website at toughtechcoatings.com/warranty-transfer.
In no event shall Tough Tech Coatings Products, Inc. be liable for any indirect, incidental, or consequential loss. Tough Tech Coatings Products, Inc. shall have no liability of any kind beyond product replacement. Tough Tech Coatings Products, Inc. further shall have no liability including but not limited to, defects or any delays caused by replacement or otherwise, including, but not limited to damages to any application or its contents.
This warranty provides the exclusive remedy for any defect in product. Claims under this warranty must be submitted by the Customer to Tough Tech Coatings Products, Inc. at toughtechcoatings.com/warranty within the warranty period as well as no later than 10 calendar days after the failure of the product(s) so that Tough Tech Coatings Products, Inc. can have a reasonable opportunity to inspect the failed area and evaluate the amount of product required for remedy.
In the event of a successful warranty claim, the customer shall be responsible for shipping and handling of all replacement products
